These Terms of Service ("Terms") govern your access to and use of the Icebreaker mobile application and website (collectively, the "Service"), operated by Icebreaker Holdings LLC ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old to use Icebreaker. By using the Service, you represent and warrant that you are 18 or older. We reserve the right to immediately terminate accounts of users found to be under 18.
You must be a human individual — corporate accounts, bots, and automated accounts are not permitted.
You agree to use Icebreaker only for lawful purposes and in ways that do not infringe the rights of others. You must not:
You retain ownership of content you submit to Icebreaker (photos, bio, messages). By submitting content, you grant us a limited, non-exclusive, worldwide, royalty-free licence to use, store, display, and reproduce that content solely for the purpose of operating and improving the Service.
You are solely responsible for the content you post. You represent that you have all necessary rights to submit such content and that it does not violate the rights of any third party.
We reserve the right to remove any content that violates these Terms or that we deem inappropriate, at our sole discretion, without prior notice.
Icebreaker requires users to verify their email address and complete a live selfie check before going live. These requirements exist to maintain community safety and trust. Attempting to circumvent these verification steps — including using photos of others or pre-recorded video — is a serious violation of these Terms and will result in immediate account termination.
Zero tolerance for objectionable content and abusive users. Icebreaker does not tolerate harassment, threats, hate speech, sexual exploitation, impersonation, fraudulent profiles, or any other content or behaviour that violates Section 3 (Acceptable Use). Accounts that engage in such conduct will be removed.
How to report. Every user profile and conversation in the app exposes a report option that lets you flag the user or content under one of five categories (harassment, inappropriate content, fake profile, spam, or other). You may also report content directly by emailing icebreaker.support@gmail.com with a description of the issue and, where possible, the offending user's display name or a screenshot.
How to block. Every user profile and conversation also exposes a block option. Blocking immediately removes the other user from your Nearby feed, prevents them from messaging you, archives any shared conversation, and is reversible only from your account's blocked-users list in Settings.
Our response commitment. We review every report and act on objectionable content within 24 hours of receipt. Action may include removing the offending content, warning the user, temporarily suspending the account, or permanently terminating the account, depending on severity and history. We will also remove abusive users from the Service.
Icebreaker offers in-app purchases of virtual items, including Icebreaker credits, Live Session credits, and bundles of those items ("Purchases"). Purchases are made through the Apple App Store on iOS or Google Play on Android, and are processed by Apple or Google under their own terms. We do not receive or store your payment card information.
Credits are virtual items licensed to you for use within the Service. They:
We reserve the right to modify the price, availability, and behaviour of any Purchase at any time. If we discontinue an item you previously bought, we will, where reasonable, replace it with credits of comparable value.
Refunds. All Purchases are final once delivered, except where a refund is required by applicable law or by the platform's own refund policy. Because Apple and Google process the payment, refund requests must be made directly to them through Apple's refund process or Google Play's refund process. We are not able to issue refunds on their behalf.
Subscriptions. If we offer subscription products in the future, those subscriptions will renew automatically through your App Store or Google Play account at the price you agreed to, until you cancel. You can cancel a subscription at any time through your platform's subscription settings. Cancellation takes effect at the end of the current billing period.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand our data practices.

Your use of the Service may be subject to the terms and privacy policies of these third parties. We are not responsible for their practices, availability, or continued support of any feature that depends on them.
Apple-specific terms. If you obtained the iOS app from the Apple App Store, you acknowledge that these Terms are between you and Icebreaker only — not Apple — and that Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app to you (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is a third-party beneficiary of these Terms and may enforce them against you.
We may suspend or permanently terminate your account at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion. If you wish to delete your account, you may do so from within the app's settings. Upon termination, your right to use the Service ceases immediately.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
ICEBREAKER IS NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER — ONLINE OR OFFLINE. WE DO NOT PERFORM CRIMINAL BACKGROUND CHECKS ON USERS. YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER USERS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ICEBREAKER AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM.
You agree to indemnify, defend, and hold harmless Icebreaker and its officers, employees, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms.
These Terms shall be governed by and construed in accordance with the laws of Wyoming, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Wyoming.
We may update these Terms from time to time. If we make material changes, we will provide at least 7 days' notice via in-app notification or email before the new terms take effect. Your continued use of the Service after that date constitutes your acceptance of the updated Terms.
